Term 1. Intellectual Property Rights

TOFG and TYB assert ownership rights over this website’s intellectual property, such except photos, but including music, written works, and graphics. TYB & Staff have created this website and own all of the original materials and indicating the contexts in which they may be used, if at all.

Term 2. Products or Services Terms

We don't ever want our customers/clients to have any reservations about the services or products that we offer. A comprehensive description is included in terms and conditions disclosures as needed delivered to each client upon commencement where appropriate. Ordinarily all legal services, preparations of briefs, forms, and the like shall occur within the time allotted or agreed subject to availability and unforeseen occurrences, court shut downs, and natural disasters of course which may cause delays. **Our function is participation in alternative dispute resolution and Pro Se Self-Help guidance, consultation, form completion, clerical document preparation,  research, legal writing, and form/case filing, as well as all needful things related to Judicial Review of ADR and Self-Help processes from a Defense and/or Offense point of view.  Our Techs and paralegals are available for subcontracting and short term hire for small projects and temporarily understaffed law practices. Inquire via email, those terms and conditions are controlled. by the subcontracting contract for services to be negotiated on a case by case basis otherwise where applicable these terms and conditions apply.

Term 3. Payment Terms

Our prices are clearly stated, or located where customers can find them. Should you be unclear or need custom pricing due to non-standard work or assistance required then the pricing shall be subject to negotiation and pricing may change without prior notice. Because many of our members, clientele, and aids are volunteers and pro bono matters, and many are elderly, retired, military, and/or business owners we do not factor into each sale applicable taxes from the costs as a gratuity to our clientele. Any shipping charges that apply will be the standard methods chosen by you for goods to be mailed and otherwise shall be digital delivery which is free via email, due date for payment shall be as disclosed in the invoices and/or payment agreement reached between the parties and/or the client and any specific account manager, tech, aid, volunteer, or clerical staff handling your matters (as assigned).  Nothing on this site creates a contractual obligation of any sort until all sums due for service are delivered as agreed.  Partial payments operate as good faith deposits and are non-refundable.

Term 4. Guarantees and Warranties

Certain products that we sell may be covered by guarantees or warranties on a case by case basis, either directly or indirectly through the manufacturer. In these instances, you should refer to the warranty delivered with any goods if any where applicable.  Note that by and large other than certain promotional items there will be no goods sold nor given away save for marketing items varying and carrying and promoting TOFG logos and certain catch phrases used by staff.

Term 5. Limitation of Liability

We do not, on occasion when blogs or editorials are posted by our members, accept any liability for offensive or defamatory postings on the site. If the website permits user-generated content, terms and conditions are that you should be kind and mindful and write it as if you were going to be judged on it for the future best job of your career because like all things on the web once it's out there - it's out there!  And once you post original works or writings they become ours to do with as we see fit subject of course to a modified version of our privacy policy where we won't disclose the original source of the work ever.

Term 6. Minor-Aged Children

This website is not per-se for Minors because they are not permitted to contract for themselves. If by chance you are a minor or need help for a minor please remember that we may only contract with the legal guardian and nothing on this site creates a contractual obligation of any sort until all sums due for service are delivered as agreed.  Partial payments operate as good faith deposits and are non-refundable. If you are a 'contracted Guardian ad litem' and contracting aid or assistance in that capacity for the minor child we will need to see a Court Order establishing that. No exceptions. This means that "uncle" and/or "aunt" and/or "friend" who is not legal guardian of record as to the Minor child we can help you file to modify that capacity and status with regards to the Minor child but we cannot, at your urging or instance, do filings or documents that it would take 'current legal guardian' or 'parent in Custody' status that does not then exist to justify.

Term 7. Future Modifications

We may want to amend this website’s terms and conditions from time to time, either to reflect changes in the business, it's structure, the services, and/or applicable law. Customers will be notified but amount of notice required in advance of changes is at least 72 hours before changes are effective and binding upon all as modifications of contracts, agreements, and etcetera.

Term 8. Rules of Conduct

End-users may only use this website for its intended person and purposes and all must follow the rules to access our services. Penalties for serious violations may include lawsuits for recovery of damages not to exceed $10,000 plus the amount of actual loss sustained and any punitive sums to be awarded to punish past disregard for the law and to encourage future respect for the law and contract rights/rights of others generally.

Term 9. Choice of Law

Any disputes arising shall be governed by the law of the State of North Carolina, and ADR forums chosen shall have exclusive jurisdiction of any disputes arising from interactions strictly where initiated by any other excluding Courts (except Courts ADR forums) in the first instance until internal remedies are exhausted with TOFG and/or TYB and Staff except where futility shall be shown.  TOFG shall reserve the right to have any matter filed in the Court of North Carolina preferred or transferred to it where initiated elsewhere by virtue of the agreement express or implied to do business with TOFG, TYB, and staff (including volunteer staff).
